A 24/7 gym week has 168 hours. In Western Australia, all of them are yours to change your mind.

Queensland’s window is 48 hours, two of the week’s seven days. Western Australia gives seven days, counted from the day you sign (or until seven days after opening day, if you signed before the centre opened). In the ACT the code requires an agreement for a period of 3 months or more to state that it is subject to a cooling off period, and where no code sets a window, the contract is where one comes from.

General information about gym membership law in each state, not legal advice. Your state’s fair trading office is linked on every page.

Queensland: the cooling-off period starts on the day the client enters into the agreement (or, if signed before the centre opened, on opening day, or when the client receives notice that it has opened if it opened on a new opening day before the supplier told the client of that day) and ends 48 hours later. Hour by hour

48 hoursQueensland

The cooling-off period, for a client entering into a membership agreement with a supplier, starts on the day the client enters into the agreement, or on the day the centre opens if the client signed before it opened (or, if it opened on a new opening day before the supplier told the client of that day, when the client receives notice that it has opened), and ends 48 hours after it starts. A written notice ends the agreement, and the refund is due within 21 days.

The cooling-off period starts on the day on which the client enters into the agreement and runs 7 days; if the client signed before the centre opened, it runs 7 days after the day it opens. The agreement can be ended at any time in the window by written notice that need not be on a form, and Consumer Protection says it can be an email.

3 months or more, or your contractThe ACT and the rest

In the ACT the code requires an agreement for a period of 3 months or more to state that it is subject to a cooling off period under clause 11 of the code. In New South Wales no state code sets a cooling-off period; check the contract, and its administration fees may be non-refundable even then. Where no code sets a window, the ACCC’s description holds: cooling-off periods are written into the terms of some contracts.
